Veranstaltungen


Entsprechend seiner Aufgabe, den offenen Austausch zwischen relevanten Stakeholdern des Geistigen Eigentums und dabei insbesondere des Patentsystems zu fördern, führt der Verein jährlich 1-3 Veranstaltungen zu aktuellen Themen durch. Die Teilnahme an diesen Veranstaltungen ist auf Vereinsmitglieder beschränkt, die Teilnahme von Nicht-Vereinsmitgliedern ist nur auf Einladung möglich, damit der Kreis nicht zu sehr ausufert. Angestrebt wird eine Gesamtteilnehmerzahl je Veranstaltung von nicht mehr als 50 Personen. Um die Offenheit des Austauschs zu gewährleisten, wird kein Protokoll geführt und werden keine Tagungsberichte veröffentlicht.

Thema soll in diesem Jahr die Leistungsfähigkeit der deutschen Patentverletzungsgerichte sein. Dazu möchten wir mit wichtigen Stakeholdern diskutieren, ob staatliche Gerichte noch die Patentkriege bewältigen können, die global aufgestellte Unternehmen heute entfesseln (können). Schon jetzt absehbar ist beispielsweise ein Konflikt über die Nutzung von Telekommunikationstechnologie-SEP durch Unternehmen der Automobilindustrie, weshalb Vertreter beider Seiten als Gäste an der Diskussion teilnehmen werden.

Vortrag von Prof. Toshiko Takenaka in englischer Sprache zum Thema: "Does Patent Quality Matter? US Patent Community’s Obsession with Patent Claim Wording"

U.S. patent community is obsessed with the wording used in the claims. Often, patent litigation focuses on the meaning of wording instead of the invention. U.S. courts frequently find a claim overboard and ambiguous when the claim scope covers more than what had been disclosed in the specification and blame USPTO for issuing a poor quality patents. Such claims are invalidated or limited to cover only disclosed embodiments. However, issuing patents only on claims, which clearly cover all disclosed embodiments, is an unrealistic expectation for USPTO. Such a wording focused claim construction also presents problems to German patent owners: Claims supported by a specification focusing on the invention may be invalidated or narrowly interpreted when they are enforced before U.S. courts.Prof. Takenaka’s presentation will examine problems resulting from differences in claim construction under U.S. and German Patent law and aims to discus with the audience possible claim and specification strategies to overcome these problems.

Speaker Biography

Prof. Toshiko Takenaka is a Washington Research Foundation/W. Hunter Simpson Professor of Technology Law at the University of Washington School of Law, Seattle, USA. She has received a visiting professorship from the state of Bavaria to teach IP Management at Technical University of Munich in the winter semester 2016/17. Prof. Takenaka served as the Director of Center for Advanced Study and Research on Intellectual Property (CASRIP) at the University of Washington School of Law between 2003 and 2015. She is on the board of editors for the Journal of Intellectual Property Law and Practice and a member of the Intellectual Property Committee within Japan’s Ministry of Economy, Trade and Industry’s Industrial Structural Council.
Prof. Takenaka holds an LL.B. from Seikei University, an LL.M. and a Ph.D. from the University of Washington School of Law. She was a visiting scholar with the Max Planck Institute for Domestic and International Intellectual Property in Munich and a visiting professor at Waseda University. She currently holds visiting professorships at Tokyo Medical Dental University, Osaka Institute of Technology, and the University of Strasbourg. She has extensively published on comparative patent law and is a frequent speaker for academic and professional seminars focusing on patent law.

Diskussionsgegenstand wird zum ersten die Bewertung von Studienergebnissen sein, die die Haltbarkeit von bis zu 80% aller für Deutschland in Kraft stehenden Patente in Frage stellen. Zweitens soll besprochen werden, ob und in welchem Umfang und mit welchen Mitteln Patentinhabern Rechtssicherheit gewährt werden kann und soll. Diese ist besonders für den Mittelstand ein erhebliches Thema, denn derzeit können Patentinhaber schon allein dadurch unter Kostendruck gesetzt werden, dass Patente statt vor dem Anmeldeamt, wo kostengünstige Einspruchsverfahren genutzt werden könnten (die aber eben auch weniger leicht Vergleiche zu Lasten des Wettbewerbs möglich machen), vor BPatG und BGH solange angeriffen werden, bis sie beschädigt sind.

Vortrag von Prof. Dr. Yuko Kimijima, LL. M. in englischer Sprache zum Thema: "Negotiating Joint Research with Universities - Rights to Patent and Trade Secret Protection in the U.S. and Japan"

When Prof. Kimijima was supervising the technology transfer department of Keio University, there were several provisions of joint research contracts that companies’ IP managers wanted to see changed, to which the university could not agree. Especially with foreign companies, it sometimes took months for the companies to understand the different status of universities and the difference of laws allocating rights to patents and providing trade secret protection in Japan.When two commercial entities negotiate joint research, both entities’ goal is to maximize profits, i.e. to achieve the result with the lowest cost and risks within the shortest period of time. In this setting, managers of commercial entities find universities’ contracts unreasonable. Prof. Kimijima will explain why universities insist on seemingly unreasonable provisions in their contracts with industry.She also will present recent developments of laws allocating the rights to patent and trade secret protection in the U.S. and Japan. Secrecy of proprietary information provided by a party to the other and/or secrecy of research information created through joint research have been strongly protected in the U.S. and Japan, while the rights to publish said research can be mutually agreed upon by the parties.Accordingly, Prof. Kimijima will discuss the pros and cons of researchers’ secrecy obligations in order to encourage research and innovation in and outside of universities.

Speaker Biography

Professor Dr. Yuko Kimijima LL.M. (George Washington), is Professor of Intellectual Property Law, Faculty of Law and Graduate School of Law at Keio University, Japan’s best private university that also is linked to TUM. She has been a Max Planck Scholar and in 1996 obtained her Ph.D. from Keio for her comparative study “Patent Invalidity and Its Procedure”. She also holds an LL.M. from George Washington University Law School, and in 2018 taught Japanese Law at the University of Würzburg as a visiting professor. Professor Kimijima’s research covers patentability and patent invalidity, inventors’ rights, employee inventions.As an attorney-at-law admitted to the Japanese bar, Professor Kimijima also advises practitioners and the Japanese Government on issues of intellectual property law and procedure. For many years, she served as Keio University’s Deputy Director General of Headquarters for Research Coordination and Administration.
